The 118' Topsail Schooner Tall Ship WINDY or WINDY II (Owned by Capt. Robert Marthai and contracted by Windy of Chicago, Ltd.) operates in all weather, 24 hours a day. Trainees live in close quarters and will be asked to participate in all ship's routines and program activities. It is the responsibility of the trainee to advise the Captain of his/her capability with respect to the ship tasks being required. Tall Ship WINDY or WINDY II is equipped with fired protection and other safety equipment as well as first aid equipment. Its officers are trained in Emergency First Aid. We have radio, cellular phones and satellite phones aboard which allow us to communicate with medical personnel, if required. Nevertheless, it is important to recognize that the ship is sometimes hours away from acute care medical services. If you have a preexisting condition, such as but not limited to diabetes, asthma, seizure disorder, heart condition, etc., which may require emergency care of special medical attention during a course, please consult your physician and disclose the condition before signing this release.

WHEREAS Tall Ship WINDY or WINDY II Windy of Chicago, Ltd run a program for persons (male or female) with the purpose being to provide a challenging shipboard environment in which trainees will develop qualities of leadership and self reliance through the medium of a sail training vessel (tall ship) program and whereas such training to take place on board the tall ship Tall Ship WINDY or WINDY II and, WHEREAS the vessel training will take place on the St. Lawrence Seaway, Lake Ontario, Lake Erie, Lake Huron, Lake Michigan, St. Lawrence River, Gulf of St. Lawrence, the North Atlantic Ocean, the Caribbean Sea, the Gulf of Mexico and other bodies of water from time to time, depending on the program.
WHEREAS THE ABOVE TERMS AND CONDITIONS HAVE BEEN READ AND UNDERSTOOD.
NOW THEREFORE, THIS ACKNOWLEDGMENT, RELEASE AND INDEMNITY AGREEMENT IS
ENTERED INTO WITNESSETH THAT:
I, _____________________________________, over the age of 18 years, inconsideration of being allowed to participate as an Executive Trainee in the programs run by Tall Ship WINDY or WINDY II, Windy of Chicago, Ltd.
I, WE, being the father or mother and/or legal guardians of _____________________________________, being under the age of 18 years, is allowed to participate in the programs run by Tall Ship WINDY or WINDY II, Windy of Chicago, Ltd.
Do acknowledge and accept all of the above and in so doing, Hereby release, acquit, discharge and agree to hold harmless and to indemnify the said Tall Ship WINDY or WINDY II, the Ships crews, Windy of Chicago, Ltd. their owners, heirs, executors, administrators, successors and
assignees and insurers of and from any and all actions, causes of actions, claims, demands, costs, loss of services, expenses and compensation, on account of in any way growing out of any and all known personal injuries, losses and property damage and any personal injuries, losses and property damage not known or anticipated by which may later develop or be discovered including all the effects and consequences thereof which I personally, or the above mentioned minor, our heirs, executors, administration, and assigns may sustain as a result of our participation in any programs run by Tall Ship WINDY or WINDY II, Windy of Chicago, Ltd. Hereby further promise and agree to bind myself or ourselves jointly and severally, our heirs, executors, administrators and assigns to indemnify and hold harmless and repay to Tall Ship WINDY or WINDY II, Windy of Chicago, Ltd. (its owners, board of directors, agents employees and staff (their owners, heirs, executors, administrators, successors and assigns any sum of money that they or any of them may hereafter be compelled to pay any person or persons because of injuries, losses or damages sustained by me or as the case may be the said minor as a result of participating in any program run by Tall Ship WINDY or WINDY II, Windy of Chicago, Ltd, as outlined by this ship's master, owners, board of directors and/or staff and employees and as agreed to on the document.
Rules/Standing Order
Drugs and/or illegal substances are strictly forbidden. If these substances are found on your person/personal gear, you will be sent ashore at the discretion of the Captain. At all times, the standing orders of Tall Ship WINDY or WINDY II, Windy of Chicago, Ltd, must be adhered to.
Tall Ship WINDY or WINDY II is a working vessel, therefore, at all times full participation is expected from crew and asked of trainees.
I/WE HEREBY AFFIRM THAT I/WE HAVE READ THE ABOVE WAIVER RELEASE IN ITS ENTIRETY AND UNDERSTAND WHAT I HAVE READ. I/WE ENTER INTO THIS AGREEMENT VOLUNTARILY AND WILL ABIDE BY THIS ENTIRE DOCUMENT.
